It is neither desirable nor possible for governments to regulate the dissemination of information to stop the spread of misinformation and disinformation. This outcome is undesirable because there is no guarantee that a possible solution to a problem is immune to political appropriation. Nor is it possible without departing significantly from First Amendment case law and providing precise definitions of misinformation and disinformation. Still, government regulation plays an important role in increasing the transparency of social media companies’ operations.
